SYVUM QUIZENIUS CONTEST RULES

HOW TO ENTER AND WIN : Only registered members of Syvum are eligible to win prizes. While you may try a contest as a "Guest", any top scores you receive will not be eligible for winning prizes. There are no restrictions in terms of the number of entries submitted by a person. Multiple entries may be submitted on the same day from the same Syvum User ID. Entries received between 12:00:00 AM, GMT on the first day of a month and 11:59:00 PM, GMT on the last day of the same month shall be eligible for the monthly drawing. Entries become the property of SYVUM. Eligible entrants must visit www.syvum.com and participate in the Syvum Quizenius Contest (SQC) by answering as many questions as they can from the Syvum database of quiz questions after registering as Syvum Members by filling out the electronic member registration form, including the entrant's name, email address, user id and password. SYVUM shall not be responsible for lost or misdirected messages, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, online failures, hardware, software or other technical malfunctions or disturbances or other communications failures or circumstances affecting receipt of entries or entrants' ability to participate in the SQC. By entering, each participant agrees to be bound by the rules and regulations of the SQC. The winners will be selected from those entrants who have correctly answered the maximum number of quiz questions. In case of a tie where entrants have correctly answered the same number of quiz questions, the prize will be shared or a single winner will be picked at random from the entrants who tied. The winners and prizes will be decided by SYVUM, whose decisions shall be final. It is the responsibility of the winners to claim their prizes by sending an email from the address used by them during registration as a Syvum Member. If a winner fails to respond within 25 days of the end of the contest, prizes will be forfeited and may be awarded to an alternate winner chosen, or added to the next month's prize fund. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered. Winner may be required to provide evidence that winner is the authorized account holder of the email address associated with the winning entry and complete an affidavit of eligibility and any applicable releases.

PRIZES : Prizes consisting of Amazon.com gift certicates (valued between five dollars and thirty dollars -- US $5-$30) will be awarded to three or more winners every month. Each winner is eligible to only one prize (gift certificate). Please go to the Amazon.com web site to read more about how to use and redeem Amazon.com gift certificates. Taxes, customs duties, shipping costs, and like amounts in connection with the prizes are the winner's responsibility. There will be no cash or other substitutes for the prizes, except that SYVUM reserves the right to substitute prizes of equal or greater value in the event that a prize becomes unavailable for any reason.

WINNERS' LIST : The official winner list will be available at the www.syvum.com site under "Syvum Quizenius Contest - Winner List" for a period of one year following the month in which the SQC was held.

USE OF ENTRANT INFORMATION : As permitted by law and in accordance with Syvum's Privacy Policy, Syvum may use information which all entrants provide about themselves to send them announcements about Syvum's products and services via electronic and ordinary mail. An entry, except where prohibited by law, constitutes a grant of permission to SYVUM or its agents to include winners' names on the www.syvum.com site and in connection with a Winners' List without further notice. By accepting a prize, winners consent to the use of their names, photographs and/or other likenesses for advertising or publicity purposes without additional compensation, except where prohibited by law.

REJECTION OF ENTRIES : SYVUM, in its sole discretion, reserves the right to reject any of the contest entries, for any reason whatsoever, without being under the obligation to disclose the reason.

UNFORESEEN EVENTS : SYVUM, in its sole discretion, reserves the right to terminate the SQC at any time, including if SYVUM becomes aware of any occurrence which would materially affect the contest's security or fairness, including but not limited to technical malfunction of the www.syvum.com site, software and/or hardware transmission failures, and virus contamination.

HOLD HARMLESS AND ARBITRATION : By entering, all entrants release SYVUM, and its affiliates, subsidiaries, vendors, agencies, officers, directors, agents, employees, suppliers and all others associated with the development or execution of this SQC from any and all liability with respect to, or in any way arising from, this contest or the acceptance, possession or use of any prizes including, without limitation, liability for any personal injury, damage or loss. As further consideration, all entrants understand and agree that the decisions of SYVUM will be final and binding, with regard to any question or dispute arising from or relating to the contest, the interpretation of official rules, and any other matters relating to the contest, not specifically covered by the official rules. In the event of any dispute arising from or relating to this contest, all entrants agree as additional further consideration to defend and hold harmless SYVUM, its officers, directors, employees and contest administrator personnel from any and all liability, cost, fees, damages, charges or expense whatsoever. All entrants understand that failure to agree to and comply with all these rules automatically disqualifies his/her entry.

CHANGE OF CONTEST RULES : SYVUM reserves the right to change these contest (SQC) rules at any time, and may choose to apply the changed rules to any of the contests, in particular, the SQC running at the time such a change takes place, the SQC(s) that occurred before the time such a change takes place, and the SQS(s) that occur after the time such a change takes place.

GOVERNING LAW :ANY CLAIMS OR CONTROVERSIES RELATING TO OR ARISING FROM THIS CONTEST SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE PROVINCE OF ONTARIO, CANADA WITHOUT REGARD TO THE CONFLICTS OF LAW PRINCIPLES THEREOF AND SHALL BE BROUGHT IN THE COURTS LOCATED IN THE PROVINCE OF ALBERTA. EACH ENTRANT AGREES TO THAT VENUE AND JURISDICTION AND THE EXCLUSIVE JURISDICTION OF THOSE COURTS AND WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS.
